Neither IE of Firefox send this header when doing form file uploads. While most servers do not care about it, this particular server won't work with it.
I tried to turn it off with curl_setopt, but it wouldn't let me, it includes it as soon as files are added to the post vars.

This is not a bug, this is by design. If you want to discuss changing the
IMHO, browsers _should_ send it and most servers do "care" about in the
PS, curl_setopt() is PHP, not the libcurl API
